1. Introduction

Florida Health Resources ("we," "us," "our") is the trade name under which Scott Black, a Florida-licensed insurance agent, operates. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit floridahealthresources.com (the "Site"), attend a dinner seminar, request information, or work with us on Medicare enrollment.

By using the Site or submitting information to us, you consent to the practices described in this Policy. If you do not agree, please do not use the Site.

2. Information We Collect

We collect information that you provide directly to us, information collected automatically when you use the Site, and information from insurance carriers and Medicare when you authorize us to help with enrollment.

Information you provide includes: name, home and mailing address, city, state, ZIP code, date of birth, telephone numbers, email address, gender, employment or retirement status, Medicare number or Medicare Beneficiary Identifier (MBI), Medicaid or VA benefit status, current health insurance information, list of prescription medications, list of preferred doctors and hospitals, questions you send us, and reservation and RSVP details for seminars.

Information collected automatically includes: IP address, browser type and version, device type, operating system, referring URL, pages visited, time on page, and general geographic region derived from IP address. This data is collected via server logs and privacy-respecting analytics.

Information from third parties includes: quote and eligibility data returned by insurance carriers after you authorize us to run a quote, publicly available business information, and communications routed through our email or phone provider.

3. How We Use Your Information

We use your information to: (a) respond to your requests for Medicare information, quotes, and consultations; (b) prepare plan comparisons based on your doctors, prescriptions, and ZIP code; (c) submit enrollment applications you authorize; (d) confirm and manage dinner seminar reservations; (e) send educational materials and follow-up communications you have requested; (f) comply with legal and regulatory obligations, including CMS Medicare Marketing Guidelines; (g) prevent fraud and secure our systems; and (h) improve the Site.

4. Legal Bases and CMS Compliance

Because we help with Medicare enrollment, we follow the Centers for Medicare & Medicaid Services (CMS) Medicare Communications and Marketing Guidelines. Scope of Appointment (SOA) documentation is required before we discuss specific Medicare Advantage or Part D plans. We retain SOA and enrollment records for the period required by CMS (currently 10 years).

5. How We Share Information

We share information only in the following circumstances: (a) with insurance carriers when you authorize us to quote, enroll you in, or service a plan; (b) with subcontractors and service providers (e.g., email, website hosting, CRM, secure file storage) that are contractually required to protect your information and use it only to perform services for us; (c) with regulators, CMS, or law enforcement when required by law, subpoena, or governmental request; (d) to protect the rights, safety, or property of Florida Health Resources, our clients, or others.

We do not sell, rent, or trade your personal information. We do not share your information with third-party advertisers or data brokers.

6. TCPA & Marketing Communications

By providing your telephone number and consenting on a form, you authorize Scott Black and his office to contact you at that number regarding Medicare-related products and services, including by manually dialed call, prerecorded message, text message, or email. Consent is not a condition of purchase. Standard message and data rates may apply.

You may opt out of marketing communications at any time by replying "STOP" to any text message, clicking the unsubscribe link in any email, or calling 941-302-0314. Opting out of marketing does not stop transactional communications required to service an active policy.

7. Cookies and Similar Technologies

We use limited cookies to keep the Site functional and to measure aggregate visitor behavior. See our Cookie Notice for full detail. You may disable cookies through your browser settings; some features may not function correctly.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy and to comply with our legal obligations. Enrollment-related records are retained for the CMS-required period (currently 10 years). Website analytics data is retained in aggregated form.

9. Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit (HTTPS/TLS), secure carrier portals for enrollment submissions, and access controls on internal systems. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Data Breach Notification

In the event of a security incident affecting your personal information, we will notify affected individuals and, where applicable, regulators as required by Florida law (Fla. Stat. §501.171) and other applicable statutes.

11. Your Rights

Depending on where you live, you may have the right to: (a) access the personal information we hold about you; (b) request correction of inaccurate information; (c) request deletion, subject to legal and regulatory retention requirements; (d) opt out of certain uses of your information; (e) receive a copy of your information in a portable format; and (f) not be discriminated against for exercising these rights.

12. California, Colorado, Virginia & Other State Rights

If you reside in a state with a comprehensive consumer privacy law (including California under the CCPA/CPRA), you may have additional rights, including the right to know what personal information we have collected and the categories of parties with whom we share it. We do not sell personal information as defined by these laws.

13. Children's Privacy

This Site is intended for adults age 18 and over. We do not knowingly collect personal information from children under 13. If you believe a child has submitted information, contact us and we will delete it.

14. Third-Party Sites

The Site may link to third-party sites, including Medicare.gov and carrier portals. We are not responsible for the privacy practices of those sites. Review their policies before providing information.

15. Do Not Track

Some browsers offer a Do Not Track (DNT) signal. Because no consistent industry standard exists, we currently do not respond to DNT signals. We treat all visitors the same, whether or not DNT is enabled.

16. Changes to This Policy

We may update this Policy from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes constitutes acceptance.
